How to become an Industry Member/Estate Agent

Estate Agency Affairs Act, 1976


To provide for the establishment of an Estate Agency Affairs Board and an Estate Agents Fidelity Fund; for the control of certain activities of estate agents in the public interest; and for incidental matters.

The core function of the Registration department is to ensure the management of the registration processes of all applications pertaining to Fidelity Fund Certificates.  This includes the following:

The registering of: new applications for companies;

  • Change in firm ownership;
  • Change of trading names;
  • New Principal applications
  • New Interns
  • Full Status applications
  • Annual renewals
  • Submission of Audit Reports
  • Trust Accounts

 

Application for registration consists of three parts, namely:

  • Registration as an employee Estate Agent (EA) under a registered Estate Agency, that requires a valid Fidelity Fund Certificate are:
    • Intern estate agent;
    • Full status estate agent;
    • Principal estate agent;
    • Registration for a new company.
  • Registration as an attorney – Certificate issued in terms of Section1 of the ACT (but is not a Fidelity Fund Certificate)


For the purposes of section 7, 9(1)(a), 16, 26, 27, 28 and 33, includes any person who is employed by an attorney or a professional company as defined in section 1 of the Attorneys Act, 1979 (Act No. 53 of 1979), otherwise than as an attorney or an articled clerk, and whose duties consist wholly or primarily of the performance of any act referred to in subparagraph (i) or (ii) of paragraph (a) on behalf of such attorney or professional company;

  • does not include an attorney who, on his own account or as partner in a firm of attorneys or as member of a professional company, as defined in section 1 of the Attorneys Act, 1979 (Act No. 53 of 1979), or an articled clerk as defined in the said section of that Act, who performs any act referred to in paragraph (a), in the course of and in the name of and from the premises of such attorney's or professional company's practice:

Provided that such an act is not performed:-

i) In partnership with any person other than a partner in the practice of that attorney as defined in section 1 of the Attorneys Act, 1979 (Act No. 53 of 1979); or
ii) Through the medium of or as a director of a company other than such professional company;


THE EAAB NO LONGER ACCEPTS CHEQUE PAYMENTS
November 7, 2011
All Estate Agency Affairs Board (EAAB) staff, estate agents and stakeholders and new applicants are hereby informed that, with effect from 1 December 2011, the EAAB will no longer be accepting any payments made by cheque.

Trust Account Compliancy

By law, all firms (Agencies) must have a trust account when registering, as well as appointed auditors to audit this account.

Submission of Auditor's Reports
June 16, 2011
Estate Agencies are reminded of the due date for the submission of Auditor’s Reports which is four months from the financial year end of each Estate Agency.

FFC Renewal Process
June 16, 2011
As part of the Estate Agency Affairs Board statutory mandate and legislation, it is the requirement of all estate agents wishing to operate within the residential property industry to be in possession of a valid Fidelity Fund Certificate (FFC).

Intern Application Form
This application form must be completed and submitted to the Board: by all persons who have not yet passed the prescribed Board examination or who have not been exempted by the Board from having to pass such examination; and under cover of a letter by his / her principal confirming his / her employment as indicated herein.

Principal Estate Agent Application Form
This application form must be completed and submitted to the Board: by all "full status" estate agents and persons employed by attorneys; and by all directors of a company, members of a close corporation, partners of a partnership, Sole proprietors; and under cover of a letter by his / her principal confirming his / her employment as indicated herein.

Firm Application Form
This application form must under all circumstances be lodged together with an application form duly completed by every Director, Member of Close Corporation, Partner or Sole Proprietor referred herein, Directors, Members of Close Corporations, Partners or Sole Proprietors already registered with the Board in the abovementioned capacities need not complete a further application form and will not be liable for the payment of any further fees.

This application form must be completed and submitted to the Board: by all "full status" estate agents and persons employed by attorneys; and by all directors of a company, members of a close corporation, partners of a partnership, Sole proprietors; and under cover of a letter by his / her principal confirming his / her employment as indicated herein.
