THESE TERMS AND CONDITIONS ARE BINDING AND TO EACH APPLICANTS AND PERSONS UTILISING AND ACCESSING THE FFC ONLINE REGISTRATION WEB PAGE OR ANY PART THEREOF (EAAB ONLINE REGISTRATION WEBSITE).

My EAAB webpage

The “MY EAAB” webpage of the EAAB website provides applicants and Users with online access to the use of the Online Registration services for the issuing of a valid Fidelity Fund Certificate (FFC).

The webpage shall only be utilized for the following intended purposes:

• Online registration for the issuing of FFCs
• Attachment of required documents online
• Renewal purpose, and
• Checking education status

1. By completing and submitting an online application form for the issue of a Fidelity Fund Certificate (FFC) you declare that:
   • You agree and comply with all the contents of the Estate Agency Affairs Act 112 of 1976,
   • You will abide with all the registration requirement, terms and conditions set out in the EAAB Act, and any other related legislations,
   • You will provide to the EAAB all the required documents necessary for registration purposes,
   • You have answered all the questions overleaf,
   • You will not hold the EAAB responsible for the delay in the issuing of your FFC due to incorrect and inaccurate information supplied to the EAAB by yourself.
2. All fields of the online application form must be fully completed.
3. Each applicant must indicate the correct firm reference number (starting with “f”) for correct allocation to the correct firm
4. Each applicant utilizing the online registration service must ensure that correct “seven digit reference” number provided is correctly indicated when making payment, otherwise the EAAB will not be able to link and allocate payment to the correct account.
5. It is the responsibility of each applicant to ensure that correct payment is made into the correct EAAB bank account number sent either by sms or e-mail.
6. Each applicant completing an online registration form must indicate on the appropriate field of the application form the “FIC Accountable Institution Number” of their firm.
7. Foreign Nationals:
   • Each foreign national must be in possession of a valid Passport book.
   • Each foreign national registering with EAAB to be issued with a valid FFC, must submit a valid work permit, study permit, certificate of asylum or any of this documents issued by the Department of Home Affairs. The EAAB has the right to either accept or reject any of the documents indicated if it is of the opinion that such document does not satisfy any of the EAAB registration requirement for the issue of a valid FFC.
8. Requirements for registration to be issued with a valid Fidelity Fund Certificate
   1. Intern Estate Agent (New entrants to the industry):
      Intern estate agent must undergo a 12 months internship programme under the supervision of a qualified principal of a registered Estate Agency. During the internship programme, intern estate agents must acquire a NQF Level 4 qualification.
      
      The following documents must be attached:
      • copy of Identity Document (ID),
      • Letter of employment from the Agency confirming employment and signed by the principal,
   2. Intern Estate Agents are required to be employed by only one Estate Agency.
   3. The Estate Agency Affairs Board will issue the Fidelity Fund Certificate to the estate agent concerned and only on the issue of these certificates, may such estate agent commence to practice.
   4. Any person practicing as an estate agent without a valid Fidelity Fund Certificate shall not be entitled to any remunerations in terms of section 34(A) of the Estate Agency Affairs Act.
   5. Any Fidelity Fund Certificate issued in error shall be withdrawn and immediately recalled.
   6. Estate agents who ceases, or wish to cease practicing as such, are required to inform the EAAB in writing within fourteen (14) days.
   7. The EAAB, having satisfied itself with all evidence pertaining to the agent/agency, reserves the right to:
      • Suspend registration of the agent/agency,
      • Terminate the registration of the agent/agency,
      • Recall any FFCs issues,
      • Charge or impose any fine relevant to the agent/agency.
9. Renewal of Fidelity Fund Certificate
   • The validity of Fidelity Fund Certificate is 01 January of a year or from the date of issue until 31 December of the same year.
   • Estate Agents are required to renew their Fidelity Fund Certificate by no later than the renewal due date of 31 October of each year.
   • Irrespective of the issuing of renewal statement by EAAB, It is and will always be the responsibility of each registered estate agent to ensure that their Fidelity Fund Certificate are renewed on time before the renewal due date of 31 October of each year in order to be issued with a valid Fidelity Fund Certificate for the following year.
