IMMEDIATE PRESS RELEASE AGAINST ZINGLE ESTATES CC TRADING AS ADPROP

THE SOUTH GAUTENG HIGH COURT, PRETORIA, HAS GRANTED THE ESTATE AGENCY AFFAIRS BOARD A FINAL INTERDICT AGAINST ZINGLE ESTATES CC TRADING AS ADPROP and AGAINST LESLIE ELEAZER INGLESTONE andMILTON ALAN ZINN
The EAAB resolved to approach the High Court following a complaint received from a body corporate of a sectional title complex administered by ADPROP. It was alleged that there were major discrepancies between the payments that ADPROP claimed to have made to creditors of the body corporate and the records of payments received by those creditors. The EAAB immediately ascertained that neither ADPROP nor its principals, Leslie Eleazar Inglestone and Milton Alan Zinn, had been issued with valid fidelity fund certificates by the EAAB entitling them to operate as an estate agency and as estate agents respectively, as required by the relevant provisions of the Estate Agency Affairs Act.
After hearing the matter the South Gauteng High Court, Pretoria, granted the following final interdict against Adprop and its principals in favour of the EAAB:
an interdict restraining ADPROP and its principalsLESLIE ELEAZER INGLESTONE andMILTON ALAN ZINN from rendering any further services as estate agents;
interdicting and restraining ADPROP, LESLIE ELEAZER INGLESTONE andMILTON ALAN ZINN from dealing in any manner with their trust accounts;
- appointing Mr. Bashir Adams as Curator bonis to administer and control the trust account of ADPROP.
Mr. Adams has now duly taken over the administration and control of Adprop’s trust accounts.
The EAAB wishes to send a clear message to potential perpetrators that the tampering with, or misuse of, trust funds by estate agents will not be tolerated. Harsh steps will be instituted where there is evidence of the misappropriation or improper use of trust moneys by estate agents or, indeed, by anyone else.
