02 August 2011 The South Gauteng High Court confirms the order granted against Constantia Sectional Title Management (PTY) Ltd. and Quintin Brown

IMMEDIATE RELEASE

On 2 August 2011, the Estate Agency Affairs Board (“the EAAB”), represented by A.B. Scarrott Attorneys, confirmed the order obtained by the EAAB on an urgent basis on 24 May 2011.

The Effect of the order obtained on 2 August 2011 is that :

  1. Constantia Sectional Title Management (PTY) LTD and Mr Quintin Brown are finally interdicted from rendering any services as estate agents for so long as they do not hold valid fidelity fund certificates (such certificates having been withdrawn by order of the Court on 24 May 2011);
     
  2. Constantia Sectional Title Management (PTY) LTD and Mr Quintin Brown are finally interdicted from operating in any manner on any trust account of Constantia Sectional Title Management (PTY) LTD;
     
  3. Mr Lawrence Moepi’s appointment as curator bonis, with the powers set out in the order, is confirmed;
     
  4. Constantia Sectional Title Management (PTY) LTD and Mr Quintin Brown were ordered to pay the legal costs of the EAAB in this matter on a punitive scale.

Neither the liquidator of Constantia Sectional Title Management (PTY) LTD nor Mr Quintin Brown opposed the confirmation of the order and this relief was granted to the EAAB without opposition.

The investigation by the Commercial Branch of the South African Police of the criminal complaint laid by the EAAB, is ongoing. The criminal complaint was laid by the EAAB following the discovery of irregularities with regard to the trust funds of Constantia Sectional Title Management (PTY) LTD, which irregularities arose by virtue of the doings of Quintin Brown

The EAAB will issue a further press release once the report of the curator bonis is received.
